These Terms replace any previous website terms from the effective date above.
These Terms and Conditions apply to your use of drderme.com and to services booked, purchased or received from Dr.Derme. Important financial and cancellation terms may also be shown before or during the booking process. By using our website, you agree to the website-use parts of these Terms. By completing a booking or purchase, attending an appointment, paying a fee or deposit, completing a form, purchasing a product or receiving services from Dr.Derme, you agree to these Terms and to any booking-specific terms displayed before you confirm.

1.2 Meaning of terms
In these Terms, “Dr.Derme”, “we”, “us” and “our” mean Medcas Group Limited trading as Dr.Derme, including our clinicians, employees, contractors, associates, reception support, administrative support and authorised representatives.
“You”, “your”, “patient” and “client” mean the person using the website, making an enquiry, booking an appointment, purchasing a service, attending a consultation or receiving treatment.

2. Scope of These Terms and Consumer Rights
2.1 Scope
These Terms apply to our website, online and telephone bookings, consultations, treatments, procedures, reviews, prescriptions, products, packages, courses, forms, fees, deposits, cancellations, refunds, communications, complaints and related services. Our services are provided for personal, non-business use.
2.2 Related documents
You may also be given treatment-specific information, consent forms, aftercare instructions, package terms, prescription information or booking confirmations. Treatment-specific documents apply to clinical and treatment-specific matters. Any additional financial, cancellation or package term will only apply if it was brought to your attention before you became bound by it, unless required for patient safety or by law.
2.3 Consumer rights
Nothing in these Terms affects your statutory rights as a consumer. Where you are acting as a consumer, we will provide services with reasonable care and skill in accordance with the Consumer Rights Act 2015. These Terms do not exclude any right you may have to repeat performance, a price reduction or another remedy where such a right applies by law.
3. Website Information and Use
3.1 Website information
The information on our website is provided for general information and service-description purposes only. It does not constitute personalised medical advice, diagnosis, a recommendation that treatment is suitable for you, a guarantee that treatment will be provided, emergency medical advice or a substitute for a consultation with an appropriately qualified clinician.
We aim to keep website information accurate and up to date. However, services, prices, clinicians, clinic locations, products, protocols and treatment availability may change. We may update, amend or remove website content at any time.
3.2 Website use and materials
You must not misuse our website, interfere with its operation, attempt unauthorised access, introduce harmful code, scrape data, submit false or abusive information, impersonate another person, infringe our rights or use the website unlawfully.
Website materials, including content, branding, images, text, videos, graphics, forms and downloads, are owned by or licensed to Dr.Derme unless stated otherwise. You may use them for personal, non-commercial purposes only and must not copy, reproduce, adapt, publish, sell, scrape, train AI systems on, or commercially exploit them without written permission.
Third-party links are provided for convenience only. We are not responsible for third-party content, availability, accuracy, privacy practices or terms.
4. Services, Suitability and Results
4.1 Services
Dr.Derme provides doctor-led and practitioner-supported medical dermatology, skin, minor surgery, laser, IPL and non-surgical aesthetic services.
Services may include doctor-led dermatology, skin health, acne, scarring, pigmentation, hair loss, minor surgery, benign lesion assessment and removal, injectables where clinically appropriate, skin boosters, microneedling, subcision, chemical peels, regenerative treatments, prescription skincare, medical-grade skincare, laser hair removal, IPL skin rejuvenation, fractional laser, vascular and red vein treatments, fungal nail laser, tattoo laser treatments, reviews, aftercare and clinical photography.
Not all services are available at all clinics. Service availability may change from time to time. Where a service is a CQC-regulated activity, it is provided within the scope of the relevant registration or applicable exemption.
4.2 Suitability
All new patients require a chargeable consultation before any treatment is considered. Follow-up appointments, including appointments booked with the intention of treatment, are treated as consultations for assessment of suitability on the day.
If paid treatment is carried out during that appointment, Dr.Derme may waive, credit or redeem the consultation fee for that appointment where this is stated or agreed, the correct appointment has been booked, there is sufficient appointment time, you are clinically suitable, and the treatment is the recommended treatment for your concerns, goals and expectations. This does not guarantee same-day treatment or consultation-fee redemption.
All consultations, treatments and prescriptions are subject to clinical assessment and professional judgement. We may decline, defer, modify or stop a consultation or treatment where we consider it clinically or professionally inappropriate, including where treatment is unsafe, unsuitable, unavailable, outside our scope, affected by an incorrect appointment type, unsupported by adequate information or consent, affected by pre-care non-compliance, limited by appointment time or equipment availability, affected by safeguarding, capacity, coercion or patient-safety concerns, or made inappropriate by unrealistic expectations or behaviour.
If treatment is clinically unsuitable, not appropriate, unsafe or cannot be provided after assessment for clinical reasons, the consultation fee remains payable for the clinical time, assessment and expertise. If treatment cannot be provided because of a Dr.Derme operational issue before any meaningful clinical assessment has taken place, we will act reasonably, which may include offering an alternative appointment, credit or refund where appropriate.
4.3 Results
A consultation does not guarantee that treatment will be provided. No treatment is guaranteed to achieve a particular result. Outcomes vary between patients and may depend on diagnosis, skin type, anatomy, health, age, medication, lifestyle, previous treatment, healing response, aftercare compliance and biological variation. Before-and-after photographs, reviews, testimonials and examples of previous results are illustrative only and do not guarantee that you will achieve the same or a similar outcome.
4.4 Age restriction
We do not provide treatment to patients under 18 years of age.
5. Medical Emergencies
Dr.Derme is not an emergency medical service. You must not use our website, booking system, email, WhatsApp, social media, voicemail or general telephone line for medical emergencies. Informal communication channels are not continuously monitored and must not be used for urgent or emergency concerns.
If you have urgent or severe symptoms, including severe allergy, infection, visual disturbance, uncontrolled bleeding, neurological symptoms, severe pain, sudden swelling or any life-threatening concern, you must call 999, attend A&E or contact NHS 111 as appropriate.
If you experience concerning symptoms after treatment, you should contact us promptly using the route provided in your aftercare information, but you must not delay urgent medical care while awaiting a response from Dr.Derme.
6. Bookings and Appointment Administration
6.1 Booking
Appointments may be booked online or by telephone. A booking is not confirmed until we have accepted it and, where applicable, received the required fee, deposit, pre-payment or payment authorisation.
A copy of these Terms or a link to the current Terms, together with key booking terms, will be provided in your booking confirmation or another durable communication where required by law.
6.2 Cancelling and rebooking
You can cancel an appointment by telephone or by email to info@drderme.com. If you want a different time, please cancel and then call us to rebook, so we can confirm a new appointment with you directly. A request to rebook is subject to availability. Cancelling an appointment does not guarantee that another appointment will be available within your preferred timeframe.
For our clinic cancellation policy, cancellation by email is treated as received when it reaches our email system and contains enough information to identify the appointment, including your name, contact details, appointment date, appointment time and clinic location. This does not affect any statutory cancellation right that must be exercisable by another legally valid method. We cannot accept cancellations by WhatsApp or social media.
If you cannot use the telephone because of a disability or accessibility need, please tell us in advance and we will agree a reasonable alternative route.
6.3 Your booking information
When booking, you must provide accurate contact, medical and payment information where requested. You are responsible for checking the appointment type, clinic location, date, time, fee, deposit, pre-payment and any pre-care or form-completion requirements.
If you select or book the wrong appointment type, you remain liable for the fee for that appointment and for any additional consultation, assessment or treatment appointment required, unless the incorrect booking was caused by a confirmed error by Dr.Derme. If you are unsure which appointment to book, you should contact Dr.Derme for guidance before booking.
6.4 Booking changes and forms
We may decline, cancel or amend a booking where there has been an obvious pricing, availability, service-description, appointment-type or administrative error.
Before your appointment, we may require you to complete medical history forms, consent forms, pre-care forms, screening forms, clinical questionnaires or photography requests. If you do not complete required forms or provide required information in time, we may be unable to provide the planned consultation or treatment. The appointment may need to be converted, shortened, rescheduled or cancelled, and the relevant fee, deposit or cancellation policy may apply.
6.5 Booking terms
Key booking terms, including consultation fees, the new-patient consultation requirement, the 72-hour cancellation policy, deposit retention, package deductions, wrong appointment-type liability, any same-day consultation-fee redemption conditions, and the fact that treatment may be unsuitable after assessment while the consultation remains chargeable, will be displayed where relevant during the booking process. By completing a booking, you confirm that you accept these Terms and any booking terms displayed during the booking process.
During the booking process, you will be asked to confirm where relevant that you understand Dr.Derme operates a 72-hour cancellation and rescheduling policy; that if you give less than 72 hours’ notice or do not attend, your consultation fee, deposit, booking fee, package session or cancellation charge may be retained or charged; and that consultation fees remain payable if treatment is clinically unsuitable, unsafe or not provided after assessment.
Where relevant, you may also be asked to confirm that all new patients require a chargeable consultation before treatment is considered; that follow-up appointments, including appointments booked with the intention of treatment, are assessed for treatment suitability on the day; and that any same-day consultation-fee waiver, credit or redemption only applies where expressly stated or agreed, the correct appointment has been booked, there is sufficient appointment time, you are clinically suitable, and the treatment is the recommended treatment for your concerns, goals and expectations.
Where relevant, you may also be asked to confirm that you request Dr.Derme to begin providing services within any statutory cancellation period, and that if services begin before that period ends, you may be charged for services already provided and, where a service is fully performed, you may lose the right to cancel that service.
7. Cancellation, Rescheduling and Non-Attendance
7.1 Notice period
You must give at least 72 hours’ notice to cancel an appointment. To move to a different time, cancel within this notice period and then call us to rebook.
If you book an appointment scheduled to take place within 72 hours, the 72-hour cancellation policy applies from the time of booking. Any retained sum or charge remains subject to our reasonable loss, costs and applicable law.
7.2 Late cancellation or non-attendance
If less than 72 hours’ notice is given, or if you do not attend, the relevant consultation fee, deposit, booking fee, package session or cancellation charge may be retained or charged.
If the appointment is part of a prepaid package or course, a missed or late-cancelled appointment may be deducted from the package or course, subject to applicable law and any reduction in our loss. Repeated late cancellations or non-attendance may result in Dr.Derme requiring further pre-payment, restricting future bookings or declining to accept future bookings.
7.3 Late arrival
You must attend on time. If you arrive late, we may need to shorten the appointment, convert treatment to consultation, reschedule, cancel or decline treatment. If lateness means we cannot safely or properly provide the service in the remaining time, the appointment may be treated as a late cancellation or missed appointment.
7.4 Changes by Dr.Derme
We may cancel, postpone or reschedule an appointment where necessary, including because of clinician illness, staff absence, premises issues, equipment issues, product or medicine availability, emergency, infection prevention concerns, weather, travel disruption, regulatory requirement, power failure, IT failure, clinical safety concerns or circumstances outside our reasonable control.
Where we cancel or reschedule, we will try to offer an alternative appointment. If we cannot provide the service and no suitable alternative is agreed, we will refund any payment for the service not provided, unless another lawful arrangement applies.
8. Medical History, Consent and Aftercare
8.1 Medical history
You must provide complete, accurate and up-to-date medical information before any consultation or treatment. This may include medical conditions, medication, allergies, pregnancy or breastfeeding status, previous treatments or complications, skin conditions, scarring tendency, infections, immune or bleeding issues, recent sun exposure, tanning, new skincare, recent procedures, active infection, medication changes and any other matter that may affect treatment suitability or healing.
You must inform us of any change before each appointment. We are not responsible for adverse outcomes caused or contributed to by inaccurate, incomplete, outdated or withheld information.
8.2 Pre-care
You must follow all pre-care instructions provided by Dr.Derme. For laser and IPL treatments, failure to follow pre-care, patch-testing or sun-exposure instructions may mean treatment cannot safely proceed, and the relevant appointment fee, deposit or cancellation policy may still apply.
8.3 Consent and chaperones
Your consent is required before treatment. Before treatment, we will provide information about the proposed treatment, material risks, expected benefits, limitations, alternatives and aftercare. You must ask questions before proceeding if anything is unclear. You may decline treatment or withdraw consent before treatment begins. If you withdraw consent during treatment, we will stop where it is safe and clinically appropriate to do so.
You may request a chaperone for any examination or procedure. We may decline or defer treatment where consent, capacity or safeguarding concerns arise.
8.4 Aftercare
You must follow all aftercare advice provided by Dr.Derme. Failure to follow aftercare may increase risk, compromise results and limit our ability to provide further advice or remedial care.
9. Treatment Risks, Reviews and Follow-Up
9.1 Risks
All medical dermatology, laser, IPL, skin, minor surgery and non-surgical aesthetic treatments carry risks, limitations and expected side effects. These vary by treatment and will be explained in the relevant consultation, consent form or treatment information.
We may decline minor surgery, lesion removal, laser or IPL treatment where we consider it clinically inappropriate, suspicious, unsafe, unsuitable for our setting or better managed through NHS care, specialist care, histology-led assessment or another route. Patch testing, previous treatment or previous tolerance does not guarantee that future treatment will be free from side effects or complications.
9.2 Post-treatment concerns
If you have a post-treatment concern, you should contact Dr.Derme promptly using the route provided in your aftercare information. Post-treatment concerns may initially be assessed using photographs, written information, telephone, email, booking-system message or another appropriate route.
9.3 Reviews and further care
An in-person review is not automatically included in the treatment fee and may be offered only where authorised by Dr.Derme. Additional charges may apply for in-person reviews, further consultations, prescriptions, products, procedures, investigations, dressings, histology, laboratory work or further treatment.
10. Prescriptions, Products and Laboratory Fees
10.1 Prescriptions and medicines
Some services may involve prescription-only medicines, prescription skincare, medicines administered in clinic, local anaesthetic, steroid injections, emergency medicines or other medicine-related services. Medicines will only be prescribed, administered or supplied where clinically appropriate and lawful.
We do not guarantee that a requested medicine, dose, product, prescription or treatment will be provided. Prescribing decisions are made according to clinical judgement, safety, professional standards and applicable law. Repeat prescribing may require further assessment and may be declined where not clinically appropriate or safe.
10.2 Prescription products
Prescription products are supplied for a named patient following clinical assessment and cannot usually be returned, exchanged or refunded once dispensed, supplied, collected or delivered, unless faulty or incorrectly supplied. You must use prescription products only as directed and must not share them with another person.
Where a product or medicine is supplied by a third-party pharmacy or provider, that provider’s own terms may also apply. Dr.Derme is not responsible for delays, stock shortages, delivery issues or dispensing decisions by a third-party pharmacy or provider, except where caused by our failure to use reasonable care and skill.
10.3 Retail skincare
Retail skincare products may only be returned where required by law, where faulty, or where Dr.Derme agrees to accept a return. We cannot usually accept returns for products that are opened, used, personalised, damaged, temperature-compromised, prescription-only, dispensed, hygiene-sensitive or unsuitable for resale.
10.4 Histology, pathology and laboratory fees
Histology, pathology and laboratory fees are separate where applicable and are usually estimates unless confirmed otherwise. Further fees may apply depending on findings, additional tests, repeat sampling, specialist reporting, referral, further consultation or further treatment. Laboratory reporting times and specialist testing requirements may be outside Dr.Derme’s control. Once a sample has been taken, sent or laboratory work requested, related fees are usually non-refundable.
11. Prices, Payment, Deposits and Refunds
11.1 Guide prices
Prices shown on the website, booking system, social media, messages, adverts, emails or printed materials are guide prices unless expressly stated otherwise. The final price may depend on the consultation findings, diagnosis, treatment area, complexity, time required, number or type of lesions, product or medicine used, practitioner level, prescription, histology, pathology or laboratory charges, package terms, and whether further consultation, treatment, review or follow-up is required.
We will take reasonable steps to explain applicable charges before treatment. Where a price is shown as a “guide”, we will give you the total price, or a clear basis for calculating it, before you commit to treatment. If the final price will differ materially from any guide price, we will tell you before proceeding, and you may decline. You must ask before proceeding if anything about pricing is unclear.
11.2 Payment and unpaid invoices
Payment is due as stated at booking, before treatment, at the appointment or upon invoice. We may refuse to provide treatment or further services where payment is outstanding. This does not prevent Dr.Derme from providing urgent safety information or complying with legal or professional obligations.
If an invoice remains unpaid, we may charge reasonable administrative costs, suspend non-urgent discretionary services, recover debt or instruct third-party debt recovery, subject to applicable law. This does not affect your statutory rights, data protection rights, complaints rights, urgent safety information or our legal and professional obligations.
11.3 Deposits and cancellation charges
We may require a consultation fee, booking fee, deposit, pre-payment, card details or payment authorisation to secure an appointment. Unless stated otherwise, deposits are applied to the relevant appointment or service, reserve clinical time, room time, staff time and product availability, may be retained for late cancellation, non-attendance or breach of booking terms, do not guarantee treatment suitability, and are not transferable to another person without our written agreement.
Any retained fee, retained deposit, retained pre-payment, deducted package session or cancellation charge reflects a genuine estimate of the loss and costs arising from the reserved appointment time, including clinical time, room time, staff time, product allocation, administrative cost and the lost opportunity to offer the appointment to another patient. We take into account the notice you gave and whether we are able to re-allocate the appointment; where we re-fill the appointment or otherwise reduce our loss, we will reduce the charge accordingly. The deposit amount and the cancellation charges that apply are shown to you at the time of booking.
11.4 Consultation and treatment refunds
Consultation fees are payment for professional time, clinical assessment, advice and treatment planning. All new patients require a chargeable consultation before treatment is considered. Follow-up appointments, including appointments booked with the intention of treatment, are treated as consultations for assessment of suitability on the day. Consultation fees are non-refundable once the consultation has taken place, whether or not treatment is subsequently provided, unless a refund or other remedy is required by law.
Where stated or agreed, a limited initial consultation charge may be credited against treatment carried out on the same day, but only where the correct appointment has been booked, there is sufficient appointment time, you are clinically suitable, and the treatment is the recommended treatment for your concerns, goals and expectations. If no treatment is carried out, the consultation fee remains payable for the time and expertise provided.
Fees for treatment already provided are generally non-refundable. A refund is not automatically due because you change your mind after treatment, further treatment is required, the treatment requires staged sessions, expected side effects occur, a known complication occurs despite reasonable care and skill, you did not follow pre-care or aftercare, or the outcome does not match a subjective expectation that was not expressly agreed by Dr.Derme and was not clinically guaranteed.
Where there is a concern about treatment, Dr.Derme may consider appropriate remedial options according to clinical judgement and applicable law. Any further consultation, review, product, prescription, investigation, procedure or treatment may be chargeable unless expressly agreed otherwise.
11.5 Packages, courses and gift vouchers
Packages, courses and plans may be discounted because multiple appointments or services are purchased together. Unless stated otherwise, they are non-transferable, cannot be split between patients, must be used within the stated validity period, may expire if unused, and may have late-cancelled or missed sessions deducted. Any agreed refund may be calculated by charging completed sessions at the standard single-session price and refunding any remaining balance after deduction of costs, discounts, product charges, prescription charges, administrative costs and late-cancellation or non-attendance charges. If a package is refunded, completed sessions may be charged at the standard single-session price before any refund is calculated.
Gift vouchers are non-refundable and cannot be exchanged for cash unless required by law. They must be used within the validity period stated at purchase or on the voucher and are subject to clinical suitability and appointment availability. Lost, stolen, expired or damaged vouchers may not be replaced.
11.6 Purchases or bookings made for another patient
Where a booking, service, treatment, product, package, course, voucher or membership is purchased, booked or paid for by one person for another person, the payer confirms that they are doing so for the benefit of the named patient or intended recipient. Unless Dr.Derme agrees otherwise, the named patient or intended recipient may manage and use the booking or purchase and may make related decisions, including appointment changes, exchanges, upgrades, transfers, credits, cancellations and refund requests, subject to these Terms, clinical suitability, our cancellation and refund policies, payment-provider requirements and applicable law. Dr.Derme may require reasonable evidence of identity, authority or payment details before processing any refund, transfer, credit or account adjustment. Nothing in this paragraph affects statutory rights.
12. Consumer Cancellation Rights for Distance Bookings
12.1 Distance bookings
Where you book or purchase services online, by telephone or another distance method, statutory cancellation rights may apply in some circumstances. Certain healthcare, medical, prescription, personalised, hygiene-sensitive or fully performed services may be excluded from cancellation rights where the law permits.
12.2 Starting services during any cancellation period
If cancellation rights apply and you ask us to begin providing services during the cancellation period, you agree that we may begin before that period ends. If you then cancel after we have started work, you may have to pay a proportionate amount for services already provided. Where a service has been fully performed with your agreement, you may lose the right to cancel that service.
Nothing in this section affects your statutory rights where services are not provided with reasonable care and skill or goods are faulty.
13. Clinical Records, Confidentiality and Payment Disputes
13.1 Records and privacy
We create and maintain patient records, including clinical photographs where appropriate, to support safe care, professional accountability, legal, regulatory, insurance and continuity-of-care requirements. Patient clinical records are held within our secure clinical record system with role-based access.
Clinical records are retained in accordance with our Privacy Policy, clinical-records policy and applicable legal, regulatory, professional and insurance requirements. We process personal data in accordance with our Privacy Policy, UK GDPR and the Data Protection Act 2018, and use cookies as described in our Cookie Policy. Our Privacy Policy explains how we may process personal data, including special category health data where necessary, for payment disputes, chargebacks, debt recovery, complaints, legal claims, regulatory obligations and safeguarding. Separate written consent is required for identifiable photographs or videos to be used for marketing, social media, website, promotional or public-facing purposes.
13.2 Confidentiality
We treat clinical information confidentially and will only share information where necessary, lawful and proportionate, as explained in our Privacy Policy.
13.3 Payment disputes
If you raise a payment dispute, chargeback or refund claim, or if payment recovery or debt management is required, we may provide the payment provider, card provider, professional adviser, debt-recovery provider or relevant dispute body with information reasonably necessary to respond to the dispute or recover the outstanding amount. This will usually be limited to booking, payment, attendance, cancellation, service-delivery and communication records.
Where the dispute or payment recovery can be handled without detailed clinical information, we will not disclose detailed clinical information. Detailed confidential clinical information will only be disclosed where necessary, proportionate and lawful, for example to establish, exercise or defend legal claims, respond to a formal dispute, comply with legal obligations or protect our legitimate interests.
Outstanding amounts remain payable unless and until resolved.
14. Conduct, Complaints, Reviews and Advertising
14.1 Conduct and safety
You must not behave in a way that is abusive, threatening, violent, discriminatory, harassing, sexually inappropriate, intoxicated, aggressive, coercive, unsafe, disruptive or fraudulent. We may refuse treatment, stop treatment, ask you to leave, cancel future appointments, restrict communication, report behaviour to authorities or take legal action where appropriate.
You must not attend the clinic if you have symptoms of contagious illness, active infection in the treatment area or another condition that may make attendance unsafe, unless we specifically advise otherwise. We may ask you to reschedule if there is an infection prevention or patient safety concern. The cancellation policy may still apply depending on the timing and circumstances.
We may refuse, defer or stop treatment if safeguarding, coercion, vulnerability, exploitation, consent, capacity or patient safety concerns arise. We may share information without your consent where required or permitted by law, including for safeguarding, serious risk of harm, medical emergency, legal obligation, regulatory requirement or professional duty.
14.2 Reasonable adjustments
Please tell us as soon as possible if you require reasonable adjustments, accessible information, interpreter support, communication support, mobility assistance or other support. We may need notice to arrange certain adjustments. We may reschedule where this is necessary to provide safe and appropriate care.
14.3 Complaints
We take complaints seriously and aim to resolve concerns fairly and promptly. Complaints may be made by email, telephone, website form, in writing to one of our clinics, or by speaking to a member of staff. Depending on the nature of the complaint, we may signpost you to an appropriate organisation, such as the GMC, CQC where applicable, the ICO for data protection concerns, an independent complaints resolution body where available, or another relevant body.
14.4 Reviews and advertising
We may invite you to leave a review or provide feedback. If we invite reviews, we ask for honest feedback and do not require positive reviews. Reviews and testimonials reflect individual experiences and are subject to clause 4.
We will not disclose confidential clinical information in response to a public review, except to the extent that you have already made that information public in your review and it is lawful, necessary and proportionate for us to refer to it in order to respond.
We aim to ensure our advertising is responsible and clinically appropriate. We do not advertise prescription-only medicines to the public, and cosmetic-intervention advertising must not be directed at under-18s.
15. Liability
15.1 No unlawful exclusion
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or breach of statutory rights.
15.2 Losses outside our responsibility
Subject to clause 15.1, we are not liable for losses caused by:
- inaccurate, incomplete, outdated or withheld information supplied by you;
- failure to follow pre-care or aftercare;
- expected side effects or known risks that were fairly explained before treatment, provided we used reasonable care and skill;
- known complications where reasonable care and skill were used;
- outcomes that vary for the reasons described in clause 4;
- unrealistic expectations;
- delay in seeking urgent medical care;
- third-party systems, platforms or providers where the loss is outside our reasonable control and not caused by our failure to exercise reasonable care and skill;
- misuse of website information;
- events outside our reasonable control.
15.3 Other losses
We are not responsible for indirect or consequential loss, business loss, loss of profit, loss of revenue, loss of opportunity or loss of goodwill.
Where we are liable to you, our liability will be limited to losses that are reasonably foreseeable and directly caused by our breach, except where the law does not allow such limitation.
16. General Legal Terms
16.1 Events outside our control
We are not responsible for delay or failure caused by events outside our reasonable control. Where such an event affects your appointment, we will take reasonable steps to contact you and rearrange where appropriate.
16.2 Transfer
Subject to clause 11.6, you may not transfer your booking, package, course, voucher, prescription, treatment plan or rights under these Terms to another person without our written agreement. We may transfer our rights or obligations to another organisation as part of business restructuring, sale, merger or service reorganisation, provided this does not materially reduce your rights.
16.3 Severance and waiver
If any part of these Terms is found to be invalid, unlawful or unenforceable, the remaining parts will continue in force. If we do not enforce a right immediately, this does not mean we have waived that right.
16.4 Updates
We may update these Terms from time to time. The version in force at the time of your booking will usually apply to that booking. Updates will not materially reduce your rights for an existing booking unless required by law, regulation, patient safety or professional guidance. The latest version will be available on our website.
16.5 Governing law
These Terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, subject to any mandatory consumer rights that allow you to bring proceedings elsewhere.
